Hati Health - Terms of Use

The Terms & Conditions outlined herein (“Agreement”) is a contract between you and Hati Health Philippines Inc. and applies to your use of the Hati Health Services (“Services”). By accessing and continuing to use the Services, you agree with and accept all of the terms and conditions contained in this Agreement. If you do not agree to these Terms and Conditions, do not use or access our service.
This is an important document which you must consider carefully when choosing whether to use the Services.
The Hati Health Services are owned and operated by Hati Health Philippines Inc. located at 2nd Floor Zeta Building #25D 191 Salcedo St., Legaspi Village Makati City 1229, Philippines. The Services may be provided or be accessible via multiple websites or applications whether owned and/or operated by us or by third parties, including, without limitation, the website www.hati.health and its related platforms and channels. We may also be using third party channels and Messaging Apps such as Viber, Whatsapp, Facebook Messenger. Hati Health enables consumers to find, book and avail of different wellness, nutrition, fitness, medical and healthcare services, products, classes, offered and operated by clinics, doctors, providers, Service Provider or other third parties through our platform. Hati Health may also be facilitating medical consultations when conducted in person or via smartphone app, web-based communication or via telephone by a licensed third party Service Providers (collectively, “Services”).
By accessing or using the Platform, you are entering into this Agreement. You should read this Agreement carefully before starting to use the Platform. If you do not agree to be bound to any term of this Agreement, you must not access the Platform.
When the terms "we", "us", "our" or similar are used in this Agreement, they refer to any company that owns and operates the Platform (the "Company").

- GENERAL
By accessing or using the Hati Health Site (www.hati.health), the Hati Health Wellness Assistant available via its various Messaging App channels, or other Service provided by Hati Health online or offline, you agree to comply with and be legally bound by this Agreement, as revised from time to time.
We may amend or modify this Agreement at any time and without prior notice, and the revised Agreement shall be effective from the time it is posted on the Site or such other date as may be indicated by us. Your continued use of the Site and any affiliate websites following the posting of changes to these terms and conditions will be taken as your acceptance of the amended terms and conditions.
By accessing and using the Services, you consent to our processing your information consistent with our Privacy Policy at https://hati.health/privacy-policy. Please review the Privacy Policy for a description of how we may collect and use your personal information. The Privacy Policy is hereby incorporated into these Terms of Use by reference and constitutes a part of these Terms of Use.
By using the Services as an Enterprise User, you acknowledge and agree that Hati Health may share certain personal data with your employer or health plan in their role as payor as may be required for accounting and billing purposes, including without limitation your enrollment status and your Hati Health package, or as otherwise consistent with Hati Health’s obligations under applicable data privacy laws.
- OUR RELATIONSHIP WITH YOU
This Service is intended for use only by persons who are at least 18 years of age. If you are under 18 years of age, do not use or access the Services at any time or in any manner. By using the Service, you affirm that you are over the age of 18. Hati Health does not seek through this Service to gather personal information from or about persons under the age of 18. To the extent that Service users provide information about other persons under the age of 18, Service users represent that they do so with express consent of a parent or legal guardian. Service Providers may decline to enroll a Service user if, based on the provider's professional medical judgment, the Service user is not well-suited for the program.
The content of the Site and the Services, including without limitation, text, copy, audio, video, photographs, illustrations, graphics, and other visuals, is for informational purposes only and does not constitute professional medical advice, diagnosis, treatment, or recommendations of any kind by Hati Health.
Hati Health helps you access wellness information, find services and products, participate in wellness programs and connect with licensed Service Providers, accredited clinics and/or hospitals and online pharmacies (“Service Providers”). We only facilitate the connection between you and the Service Providers through use of the Services.
Hati Health is an independent contractor for all purposes. You should always seek the advice of your qualified health care professionals with any questions or concerns you may have regarding your individual needs and any medical conditions. All information provided by Hati Health, or in connection with any communications supported by Hati Health, is intended to be for general information purposes only, and is in no way intended to create a provider-patient relationship as defined by applicable laws. Hati Health is not responsible for the quality and appropriateness of the information provided to you. Hati Health does not provide any legal advice or representations in any way regarding any legal issues associated with advice, information, goods, or services offered by or through the Services, including but not limited to any compliance obligations or steps necessary to comply with any laws and regulations. Your interactions with any medical expert or provider via the Site facilitated by Hati Health are not intended to take the place of your relationship with your regular health care Service Providers or primary care physician. Neither Hati Health, nor any of its subsidiaries or affiliates or any third party who may promote the Site or Service or provide a link to the Services, shall be liable for any information or advice obtained via the Site or Service, nor any information obtained on the Site. Hati Health does not recommend or endorse any specific tests, physicians, medications, products, or procedures. You acknowledge that your reliance on any information delivered via the Site or Service is solely at your own risk and you assume full responsibility for all risks associated herewith. Hati Health does not make any representations or warranties about the training or skill of anyone who delivers services via the Site or Service.
The Service Providers who deliver services through the Hati Health Services are independent professionals practicing within a group of independently owned professional practices. Certain Service Providers may be acting within the scope of their license when providing Services to users where licensed. However, Hati Health does not practice medicine or any other licensed profession, and does not interfere with the practice of medicine or any other licensed profession by Service Providers, each of whom is responsible for his or her services and compliance with the requirements applicable to his or her profession and license. Neither Hati health nor any third parties who promote the Services or provide you with a link to the Services shall be liable for any professional advice you obtain from a Service Providers via the Service.
THE SERVICE IS NOT A CRISIS SERVICE. IF YOU EXPRESS THOUGHTS REGARDING HARMING OR DANGER TO YOURSELF OR ANOTHER TO A Service Providers, OR GENERALLY VIA THE SERVICE, THE Service Providers OR AN ADMINISTRATOR MAY CONTACT EMERGENCY SERVICES ON YOUR BEHALF.
Prior to accessing the Services, you represent and warrant that you are at least eighteen years of age and possess the legal right and ability, to: (i) agree to this Agreement; (ii) register for the Services under your own name; and provide true, accurate, current, and complete information on the registration form and to keep this information current and updated as needed; and (iii) use the Services in accordance with this Agreement and abide by the obligations hereunder. You agree that you can only access the Services in the territories where Hati Health is currently offering access to the Services.
- HATI HEALTH WELLNESS ASSISTANT
Hati Health operates a Wellness Assistant which is utilising artificial intelligence. The Hati Bot helps you quickly find information about Hati Health’s products and services on our website. It is available 24/7 to respond to your inquiries. The Chatbot may solicit personal information to facilitate your requests or questions, but we assure you that it is in compliance with the Data Privacy Act of 2012. The Hati Bot helps you seek information about your wellness, various conditions, provide information and connect you with licensed professionals. The Wellness Assistant is available through the Hati Health Messaging Apps on Viber, Facebook Messenger, Whatsapp, web, and other channels we may support from time to time, operated by Hati Health or in collaboration with third-parties. By using our Hati Bot, you signify that you are legally allowed to give your consent and agree to be bound by these Terms. If you are acting on behalf of a corporation, partnership, organization, or other legal entity, you must be authorized and eligible to bind such entity with these Terms.
You agree to: (i) fully, accurately and truthfully provide information to the Hati Health Wellness Assistant, available through the various supported channels; and (ii) prohibit anyone else from using your Hati Health account. You agree to provide accurate, current and complete information about yourself, and to periodically review and to update such information as needed to keep it accurate, current and complete. You agree to immediately notify us of any actual or suspected unauthorized use of your account, profile or credentials or other security concerns of which you become aware.
You agree that you have the following responsibilities:
(a) to be fully responsible for all access to, use of, any transactions or other activities using the Hati Bot;
(b) to safeguard the confidentiality of any account or personal information;
(c) to ensure the security of your device and not to perform any activity that could potentially compromise its security, including but not limited to jailbreaking or rooting;
(d) to immediately report to us if you think that there is any breach of security or unauthorized transaction using our Hati Bot;
(e) to ensure that your device meets the minimum system requirements; and
(f) to defend, indemnify, and hold us harmless from any claims arising from your violation of these Terms.
You are responsible for providing valid, accurate, and current information. You represent and warrant that you own all information, data, or any other materials that you will submit through the Chatbot.
You also agree to reasonably cooperate with us regarding any investigation, complaint, or issues regarding the Chatbot or these Terms.
You agree to the entry of your medical records into Hati Health’s, through the supported channels, to our database, and understand that reasonable measures have been taken to safeguard your medical information, in accordance with any applicable standards. We acknowledge your privacy and, in accordance with our Privacy Policy, will not release information to anyone without your written authorization or as required or permitted by law.
You accept that materials on the Chatbot are for informational purposes only, some details may vary for different types of clients. While we do our best to update all details here, we do not guarantee that these will be accurate all the time.
We use artificial intelligence and machine learning in order to analyze, develop, improve our Products and Services, and provide you with seamless experience and services;
The Chatbot cannot access account details and will not be able to answer any questions specific to your account.
The Chatbot has limited capacity and may not be able to answer your question or provide the information that you are seeking. We are not responsible if information made available by the Chatbot is not accurate, complete or current as applied to your specific inquiry, since the Chatbot is for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any sole reliance on the responses provided by the Chatbot is at your own risk. Further, the responses the Chatbot provides should not be considered as official statements of Hati Health for your specific situation. Always consult with a Healthcare Professional for any medical questions and concerns.
Hati Health, and its affiliates, is not responsible for any costs, damages or losses that you may suffer as a result of your sole reliance on the answers provided by the Chatbot, the accuracy or completeness of said responses.
We may monitor and/or record the discussion you have with the Chatbot for Our protection and your protection. By using the Chatbot, you agree to the monitoring and/or recording of the discussion, and confirm that you are aware that the discussion as stored and/or collected by Us may be used by Us to enhance the quality of the Service. Any personal information which you provide the Chatbot is governed by the Hati Health Privacy Policy.
Aside from your discussions which may be monitored and/or recorded, the Chatbot may also collect the date and time you used the Services and device-related information, including your IP address.
We reserve the right to terminate the Hati Bot service at any time with or without notice to you. The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
- TELEHEALTH SERVICES
If you utilize telemedicine services, you agree that you may be entering into a separate agreement with the providers of such services that will perform the Services (the “Service Providers”). You understand and agree that Hati Health is the provider of certain administrative services only and provides access to a technology platform in order to facilitate the Services between you and the medical professionals and Service Providers. You acknowledge that Hati Health does not provide professional medical services itself and the Hati Health website is for informational purposes only. Hati Health does not provide medical advice, diagnosis, or treatment.
The Service Providers utilizing or featured on the Services are subscribers to and licensees of the Services and not employees of Hati Health. Any opinions, advice, or information expressed by a health care facility, professional or specialist using or featured on the Service are of the facility, professional or specialist alone. They do not reflect the opinions of Hati Health. Hati Health does not recommend or endorse any specific tests, providers, products, procedures, medications, devices, opinions, or other information that may be mentioned on the Services or by a licensee of Hati Health. The inclusion of Service Providers on the Service or in any professional directory located on the Services does not imply recommendation or endorsement of such Service Provider nor is such information intended as a tool for verifying the credentials, qualifications, or abilities of any Service Provider contained therein. Such information is provided on an "as-is" basis and Hati Health disclaims all warranties, either express or implied, including but not limited to the implied warranties of merchantability and fitness for particular purpose. Hati Health shall in no event be liable to you or to anyone for any decision made or action taken by any party (including, without limitation, any Services user) in reliance on information about Service Providers on the Services. The use of the Service by any entity or individual to verify the credentials of Service Providers is prohibited.
You also acknowledge that
- You consent to the treatment and care constituting the Services wherever rendered by the Service Providers (in office or via telehealth) and you intend for such consent to remain effective after a diagnosis by the Service Providers is made and treatment is recommended; We do not control or interfere with the practice of medicine or mental health care by the Providers or Service Providers, each of whom is solely responsible for directing the medical care, mental health care, and/or treatment they provide to you.
- The scope of care you receive from the Service Providers will be at the sole discretion of the Service Providers with no guarantee of diagnosis, treatment or prescription. The Service Providers will determine whether or not the condition being diagnosed and/or treated is appropriate for the Services. The Service Providers may decline to treat you with the Services if, based on the professional judgment of the Service Providers, you are not well-suited for the Services;
- Hati Health is permitted to access and store any and all of your information from your interaction with the Service Providers including, without limitation, sensitive information, as part of the administration of the Services, consistent with this Agreement and the Privacy Policy;
- There are risks associated with the Services, including, but not limited to, the following: 1) loss of records from failure of electronic equipment; 2) power failures with loss of communication; and 3) invasion of electronic records by outsiders (hackers), understanding that it is impossible to list every possible risk;
- You have the right to withhold or withdraw your consent to the Services at any time without affecting your right to future care or treatment. You have the right to discuss any treatment plan with the Service Providers, including the purpose, potential risks and benefits of any test, treatment or care plan.
- You have the right to request a copy of all medical information transmitted during the provision of the Services, which is described in more detail in the Privacy Policy;
- You understand that Hati Health is not liable for any advice, course of treatment or other level of Service provided to you by the Service Providers. Hati Health acts as a facilitator and is not responsible for the administration of the healthcare services by its service providers.
- By accepting this Agreement, you acknowledge and agree that, Hati Health, the Service Providers may send you messages, reports, procedure results and emails regarding your diagnosis and/or treatment as well as information regarding your care plan and wellness. You further understand and agree that it is your sole responsibility to monitor and respond to these messages, reports, and emails and that neither Hati Health nor the Service Providers will be responsible in any way and you will not hold Hati Health, or any Service Provider liable for any loss, injury, or claims of any kind resulting from your failure to read or respond to these messages or for your failure to comply with any treatment recommendations or instructions from any Service Provider. You agree that all agreements, notices, disclosures and other communications that Hati Health and the Service Providers provide to you electronically satisfy any legal requirement that such communications be in writing. You further agree that any notices provided electronically are deemed to be given and received on the date either Hati Health and/or the Service Providers transmit any such electronic communication as described in this Agreement.
- Cancellations, Reschedule, and Refunds
- If you want to cancel or reschedule your appointment, you must submit a request no less than 48 hours before the scheduled time of your consultation, procedure, or other appointment. You will then receive confirmation of your re-schedule or cancellation of your appointment, as the case may be.
- If you reschedule your appointment less than 48 hours before the scheduled appointment, 100% of the payment made shall be charged as a rescheduling fee and no refunds shall be made.
- Hati Health reserves the right to deny any request for refunds.
- Any requests for rescheduling shall be made during Hati Health Support Hours. Any requests made outside the said hours shall not be considered for purposes of complying with the timeframes above.
- LABS, DIAGNOSTICS & VACCINATION SERVICES
Hati Health has partnered with reputable providers to offer diagnostic screenings and tests referred by the healthcare providers on the Hati Health Platform. Certain laboratory products services available through the Platform, including any at-home testing kits and home services, may require a valid prescription or order by a licensed healthcare provider. You may not be able to obtain such laboratory services unless you have completed a consultation with one of the Providers, the Provider has determined the laboratory product and/or service is appropriate for you and the Provider has prescribed or ordered the laboratory product and/or service. Currently, laboratory products and services offered through the Platform can only be ordered and fulfilled through the Labs and are not available through all laboratories.
Some labs and test packages may have a validity period. Please refer to the product pages. No Refunds, cancellations or extensions will be available. Prices for products and services listed on our site are subject to change without notice. We reserve the right at any time to modify or discontinue any product or service without notice at any time.
Our Labs, Tests and Vaccination Services include Concierge service which may include:
- Hati Health team representative to quickly answer Patient’s questions or respond to
Patient’s concerns;
- Online access to Patient’s personal health record allowing Patient easy access to
Patient’s health information;
- Access to a dedicated assistant and scheduling agent;
- Prescription facilitation, including coordination of prescriptions of various
specialists and electronic refill requests, assistance with patient monitoring and
Compliance.
- Coordination of necessary referrals to other providers, inclusive of Concierge
representatives coordinating convenient appointment times for Patients.
Hati Health engages third-party partner laboratories to provide diagnostic services. We reserve the right to change or substitute the partner laboratory at any time and without prior notice.
Once your order has been endorsed or referred to a partner laboratory, we do not process cancellations or refunds. If you wish to cancel or reschedule your appointment, you must submit a request no less than 48 hours before the scheduled time of your consultation, procedure, or other appointment. You will then receive confirmation of your reschedule or cancellation, as the case may be.
If you request a reschedule less than 48 hours before the scheduled appointment, 100% of the payment made shall be charged as a rescheduling fee and no refunds shall be made.
Hati Health reserves the right to deny any request for refunds at its sole discretion.
Any requests for rescheduling must be made during Hati Health Support Hours. Requests made outside these hours shall not be considered for purposes of complying with the timeframes above.
Requests to reschedule or modify a diagnostic order after endorsement may be accommodated only at the sole discretion of Hati Health, and subject to availability and the policies of the partner laboratory.
- PHYSICAL PRODUCTS & E-PHARMACY
Prices for products and services listed on our site are subject to change without notice. We reserve the right at any time to modify or discontinue any product or service without notice at any time. We are not liable for any product or service modification, price change, suspension, or discontinuation. Certain products available through the Platform require a valid prescription by a licensed healthcare provider.
We are not responsible for stock levels managed by our third party vending partners and we are not responsible for cancellations or order changes made by our third party vendors.
Hati Health offers delivery of pharmacy products within Metro Manila and selected provinces through our accredited delivery partners.
Different delivery options are available depending on your location and preference, including:
- Same-Day Delivery – available for eligible orders placed before the applicable cut-off time, subject to delivery partner coverage and rates (Metro Manila only).
- Next-Day Delivery – available for eligible orders within Metro Manila and select provincial areas, subject to delivery partner coverage and rates.
- Regular Delivery – standard delivery timelines for Metro Manila and provincial areas, with rates as offered by our delivery partners.
Delivery fees and timelines may vary depending on the option selected at checkout. Delivery timelines are provided for guidance only and may be subject to delays outside the control of Hati Health.
Certain products, including temperature-sensitive medications, may have specific delivery requirements and may not be available for all delivery options or locations.
You understand prescription products listed in the Service cannot be not refunded or exchanged for cash or otherwise, unless due to fault of the Service or the Service Provider or other third-party, as applicable with the Policy of such third-party:
- Damaged or Defective Products: If you receive a damaged or defective product, please contact our customer support team immediately. We will arrange for a replacement or refund, depending on your preference.
- Expired Medications: If you receive an expired medication, please notify us within 7 days of delivery. Our Provider will replace the product or provide a refund.
- Order Errors: If we make an error with your order (e.g., wrong product, incorrect quantity), please contact us within 7 days of receiving the product. We will arrange for a return or reshipment at our Provider’s expense.
- Your Hati Health Account
You do not need to register an Account with us to visit and view the Platform. However, to access certain password-protected areas of the Platform and to use certain Services, you must register for an Account. To register for an Account, you must provide us with your first name, last name, e-mail address, and password. In order to avail of the Services, you will be required to provide certain personally identifiable information including your gender, mobile number, home address, date of birth, and medical or health information prior to finalizing a purchase. You consent to Hati Health collecting and storing this information to enhance your experience, personalize recommendations, and improve the quality of services provided.
You warrant and represent that all registration information provided by you is truthful and accurate. You are required to update your registration information as necessary if there are any changes. All registration information and any other personal information that you provide to us through your use of the Service is subject to the terms of our Privacy Policy.
Password Security
You must create a password for your Account. You are solely responsible for the confidentiality and safekeeping of your password, as well as for any use of the Platform or any Services made using your password. You agree to:
- Keep your password confidential and use only your email address and password when logging in;
- Immediately notify Hati Health of any unauthorized use of your Account, email address, and/or password; and
- Ensure that your Account information is accurate and up-to-date.
You are fully responsible for all activities that occur under your Account, including activities done under your name or Account. Hati Health shall not be liable for any loss or damage arising from unauthorized use of your password or your failure to comply with this section.
Access, Preservation, and Disclosure
You acknowledge, consent to, and agree that Hati Health may access, preserve, and/or disclose your Account information and Content to any legal, regulatory, or governmental authority, the relevant rights owner, or other third parties if required to do so by law, pursuant to an order of a court, or lawful request by any governmental or regulatory authority having jurisdiction over Hati Health, or in a good faith belief that such access, preservation, or disclosure is reasonably necessary to:
- Comply with legal process;
- Enforce these Terms;
- Respond to claims that any Content violates the rights of third parties, including intellectual property rights;
- Respond to your requests for customer service; or
- Protect the rights, property, or personal safety of Hati Health, its Users, and/or the public.
Storage and Sharing of Results
Diagnostic results, lab reports, and other service-related documents may be stored in your Hati Health account for your convenience. You may access, download, or share these results through your Account in accordance with our platform’s functionality and security measures.
You authorize Hati Health to receive results, reports, or other relevant data from our Service Providers and partner laboratories, clinics, or service providers, solely for the purpose of making these results available to you and ensuring continuity of care.
Hati Health may use anonymized or aggregated data for service improvement, research, or analytics, provided your personal identity is not disclosed without your explicit consent.
All data shared with or stored by Hati Health will be protected using appropriate technical, administrative, and physical safeguards. Access to your personal and medical information is limited to authorized personnel and service providers involved in delivering the Services.
- USE OF PROMOTIONAL CODES
Hati Health may, at its sole discretion, create promotional codes (“Promo Codes”) that may be redeemed for account credits, discounts, or other features or benefits related to the Services, subject to any additional terms established for each Promo Code. Promo Codes may generally be used once per Client, and each benefit may only be redeemed once per Account. Promo Codes attempting to claim duplicate benefits will be voided.
Hati Health reserves the right to reject the application or acceptance of any Promo Code entered by a Client if it violates these Terms or any additional terms established for the Promo Code.
By using the Services, you agree that Promo Codes:
- Must be used for the intended audience and purpose, and in a lawful manner.
- May not be duplicated, sold, transferred, or otherwise made available to the general public (including posting to public forums), unless expressly permitted by Hati Health.
- May be disabled or revoked by Hati Health at any time for any reason, without liability.
- May only be used in accordance with the specific terms established for that Promo Code.
- Are not redeemable for cash, gift cards, or cash equivalents.
- May have an expiry date prior to use.
- THIRD PARTY PRODUCTS AND SERVICES
In connection with the provision of the Services, Hati Health, service providers providing Services facilitated by Hati Health, and/or Service Providers may, from time to time, make a recommendation to you of a product or service from a third party unaffiliated with Hati Health. Such third party product or service recommendation shall in no way be deemed an endorsement or guarantee by Hati Health of such product or service and you agree to release and hold harmless Hati Health from any and all claims you may have from the use of such third party product or service.
- AVAILABILITY
You are responsible for providing and maintaining, at your own risk, option, and expense, appropriate software and hardware capabilities (consistent with any technical, quality or other requirements described on the Site) to enable use of the Site, including, but not limited to, a computer or mobile device with internet access. You are solely responsible for any fees, including Internet connection or mobile fees that you incur while using the Site. We reserve the right to change the access configuration, including any software, hardware, or other requirements of the Site at any time without prior notice. We are not responsible for any typographical error leading to an invalid coupon. We accept no liability for any errors or omissions, with respect to any information provided to you whether on behalf of itself or third parties
- INTELLECTUAL PROPERTY
All of the content featured or displayed on the Site, including without limitation text, graphics, photographs, images, moving images, sound and illustrations (“Content”), is owned by Hati Health, its licensors, vendors, agents and/or its service providers. All elements of the Site, including without limitation the general design and the Content are protected by copyright, moral rights, trademark and other laws relating to intellectual property rights. The Content and services provided in the Site may be used only for the intended purpose for which the Site, and Services are being made available. Except as may otherwise be indicated in specific documents within the Site, if any, you are authorized to view, play, print and download documents, audio and video found on the Site for personal, informational and non-commercial purposes only. You may not modify any of the materials, and you may not copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer or sell any information or work contained in the Site except with our express written permission. Except as authorized under the copyright laws, you are responsible for obtaining permission before reusing any copyrighted material that is available on the Site. The Service, the Site, the Wellness Assistant, and all Content and all related rights shall remain the exclusive property of Hati Health or its licensors unless otherwise expressly agreed. You will not remove any copyright, trademark or other proprietary notices from material found on the Site or as part of the Services.

You may not use, copy, reproduce, republish, upload, post, transmit, distribute or modify the marks in any way, including in advertising or publicity pertaining to distribution of materials on this Site, without the prior written consent of Hati Health.

We are not responsible for the content of linked third-party sites, sites framed within the Site, third-party sites provided as search results, or third-party advertisements. - UNAUTHORIZED USE
Any use or attempted use of this Site: (1) for any unlawful, unauthorized, fraudulent or malicious purpose; (2) that could damage, disable, overburden, or impair the Site and/or the Services; (3) that could interfere with any other party’s use and enjoyment of the Site; (4) to gain unauthorized access to any other accounts, computer systems, or networks connected to any server or systems through hacking, password mining or any other means; or (5) for any other use other than the business purpose of which it was intended, is prohibited. Hati Health reserves the right to take whatever lawful actions it may deem appropriate in response to actual or suspected violations of the foregoing, including, without limitation, the suspension or termination of a user’s access and/or account. Hati Health further reserves the right to monitor general use of the Site at any time as it deems appropriate and to remove any materials that may violate this Agreement.
In addition, in connection with your use of the Site, you agree you will not: (a) upload or transmit any message, information, data, text, software or images, or other content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, or inappropriate with respect to race, gender, sexuality, ethnicity, or other intrinsic characteristic, or that may invade another’s right of privacy or publicity; (b) create a false identity or duplicative accounts for the purpose of misleading others or impersonate any person or entity, including, without limitation, any Hati Health representative, or falsely state or otherwise misrepresent your affiliation with a person or entity; (c) upload or transmit any material that you do not have a right to reproduce, display or transmit under any law or under contractual or fiduciary relationships (such as nondisclosure agreements); (d) upload files that contain viruses, trojan horses, worms, time bombs, cancel-bots, corrupted files, spyware or any other similar software or programs that may damage the operation of another’s computer or property of another; (e) delete any author attributions, legal notices or proprietary designations or labels that you upload to any communication feature; (f) use the Site’s communication features in a manner that adversely affects the availability of its resources to other users (e.g., excessive shouting, use of all caps, or flooding continuous posting of repetitive text); (g) upload or transmit any unsolicited advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” “phishing” or any other form of solicitation, commercial or otherwise; (h) violate any applicable local, state, national or international law; (i) upload or transmit any material that infringes any patent, trademark, service mark, trade secret, copyright or other proprietary rights of any party; (j) delete or revise any material posted by any other person or entity; (k) manipulate or otherwise display the Site by using framing, mirroring or similar navigational technology; (l) probe, scan, test the vulnerability of or breach the authentication measures of, the Site or any related networks or systems; (m) register, subscribe, attempt to register, attempt to subscribe, unsubscribe, or attempt to unsubscribe, any party for any services or any contests, promotions or sweepstakes if you are not expressly authorized by such party to do so; (n) harvest or otherwise collect information about others, including email addresses; (o) use any robot, spider, scraper, or other automated or manual means to access the Site, or copy, download, distribute or reproduce any content or information on the Site; or (p) assist or permit any person in engaging in any of these activities; or (q) record, screenshot, nor distribute any Services or part of the Hati Health site or programs or interactions.
Hati Health may terminate your use of the Site or any of our features or services if it finds, in its sole discretion, that you have engaged in fraudulent or abusive behavior, that you are utilizing the Service in a manner that is not clinically appropriate, or that you have violated any of these Terms of Use.
. You agree that if your use of the Site is terminated pursuant to this Agreement, you will not attempt to use the Site under any name, real or assumed. Except as otherwise provided in the Privacy Policy, or as required by applicable law, we have no obligation, whether before or after the termination of your use of the Site, to return or otherwise provide to you any information to us, or any other information that we have that relates to you.
Hati Health reserves the right to take whatever lawful actions it may deem appropriate in response to actual or suspected violations of the foregoing, including, without limitation, the suspension or termination of a user's access and/or account. Hati Health may cooperate with legal authorities and/or third parties in the investigation of any suspected or alleged crime or civil wrong.
Except as may be expressly limited by the Privacy Policy, Hati Health reserves the right at all times to disclose any information as Hati Health deems necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in Hati Health’s sole discretion.
Hati Health shall have the right, but not the obligation, to monitor use of the Services and to remove from the Service any materials that Hati Health, in its sole discretion, believes (i) are inappropriate, (ii) are illegal, (iii) may subject us to liability or violate these Terms of Use or applicable laws, or (iv) otherwise inconsistent with our purpose for the Site.
- INDEMNIFICATION
You agree to indemnify and hold harmless Hati Health Health, its officers, directors, employees, agents, developers, vendors, affiliates, third party providers, licensors and others involved in the development or the delivery of products, services or information over this Site, the other Hati Health channels from and against any and all liabilities, expenses, damages and costs, including reasonable attorneys’ fees, arising from your use of the Site, Services, or any products, services or information obtained from the Site and / or the Wellness Assistant, in a manner not authorized by these Terms of Use, your fraud, violation of law, or willful misconduct, and any breach by you of these Terms of Use.

HATI HEALTH DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OF THIRD PARTIES’ RIGHTS, SATISFACTORY QUALITY AND FITNESS FOR PARTICULAR PURPOSE WITH REGARD TO THE SITE, AND WITH RESPECT TO ANY INFORMATION, CONTENT, PRODUCT, SERVICE, MERCHANDISE, OR OTHER MATERIAL PROVIDED ON OR THROUGH THE SITE. HATI HEALTH DOES NOT WARRANT OR GUARANTEE THE ACCURACY, COMPLETENESS, RELIABILITY, TIMELINESS OR USEFULNESS OF THE SITE AND / OR SERVICES. HATI HEALTH DOES NOT WARRANT THAT THE SITE WILL FUNCTION WITHOUT DELAYS, DISRUPTIONS, INTERFERENCES, OR IMPERFECTIONS. SERVICES ARE PROVIDED “AS IS” AND WITHOUT ANY REPRESENTATION OF WARRANTY, WHETHER EXPRESS, IMPLIED OR STATUTORY.
- LIMITATION OF LIABILITY
IN NO EVENT SHALL HATI HEALTH, ITS PARENT, ITS OFFICERS, DIRECTORS, EMPLOYEES, ITS AFFILIATES OR ITS SUPPLIERS BE LIABLE FOR ANY SPECIAL, DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES, OR ANY DAMAGES WHATSOEVER ARISING OUT OF OR RESULTING FROM ACCESS TO, THE USE OR LOSS/INABILITY OF USE OF THIS SITE OR ANY OTHER SITE LINKED TO THIS SITE, UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA, STATEMENT OR CONDUCT OF ANY THIRD PARTY, ANY INFORMATION, DATA OR OTHER MATERIAL TRANSMITTED THROUGH OR RESIDING ON THIS SITE, ERRORS OR OMISSIONS IN THE CONTENT HEREOF, OR ANY OTHER MATTER RELATING TO YOUR USE OF OR ACCESS TO THIS SITE AND / OR SERVICES. IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS OR IF YOU SEEK TO ASSERT ANY CLAIM AGAINST HATI HEALTH ARISING OUT OF OR RELATING TO THE TERMS AND CONDITIONS OR YOUR USE OF THIS SITE AND / OR SERVICES, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THIS SITE AND / OR THE HATI HEALTH SERVICES.
- FORCE MAJEURE
We shall not be liable for delays, failure in performance or interruption of service which result directly or indirectly from any cause or condition beyond our reasonable control, including but not limited to, any delay or failure due to any act of God, act of civil or military authorities, act of terrorists, civil disturbance, war, strike or other labor dispute, fire, interruption in telecommunications or Internet services or network provider services, failure of equipment and/or software, other catastrophe, pandemic, national emergency, or any other occurrence which is beyond our reasonable control and shall not affect the validity and enforceability of any remaining provisions.
- GOVERNING LAW & ARBITRATION
Except for claims for injunctive or equitable relief or claims regarding intellectual property rights (which may be brought in any competent court without the posting of a bond), any dispute arising under this Agreement shall be finally settled by arbitration in accordance with the Arbitration Rules of the Singapore International Arbitration Center (“SIAC Rules”) for the time being in force, which rules are deemed to be incorporated by reference in this clause. The Tribunal shall consist of one or more arbitrators (if one arbitrator cannot be designated by mutual agreement of the Parties) appointed in accordance with said rules. The venue for arbitration shall be Singapore, and the language of arbitration shall be English. The arbitral award shall be final and binding on the Parties and shall be enforceable in any court having jurisdiction. The prevailing party in any action or proceeding to enforce this Agreement shall be entitled to costs and attorneys’ fees.
- ENTIRE AGREEMENT
This Agreement and any other agreements we may post on the Site or that you and Hati Health may execute from time to time constitute the entire agreement amongst Hati Health,the service providers and you in connection with your use of the Site and accessing the Services and supersede any prior agreements, including prior versions of this Agreement. For the avoidance of doubt, any agreement executed and / or entered for the use of the Messaging Apps are not specifically incorporated herein. You are still responsible to comprehend and accept such Terms and Conditions when using the services of such channels.
- CHANGES TO THIS AGREEMENT
When we make changes, we will revise the “last modified” date. We encourage you to review the Agreement periodically. Your continued use of the Hati Health Services constitutes your agreement to the updated Agreement.

1. Nature and Purpose of Telemedicine Services
Hati Health provides telemedicine services to facilitate convenient access to healthcare consultations, advice, and prescription medications for various health and wellness needs, including but not limited to consultations related to maternity care, sexual health, chronic conditions, and general wellness. Our service connects you with licensed physicians who will evaluate your medical information through online forms, questionnaires, or live consultations to determine if a treatment or prescription is appropriate. The purpose is to provide safe, professional, and effective medical care remotely.
2. Acknowledgment of Medical Risks or Side Effects
All medical treatments and medications carry potential risks and side effects. During your consultation, our licensed physicians will assess your suitability for the prescribed treatment based on the information you provide. Possible risks or side effects vary depending on the medication or treatment and may include, but are not limited to, allergic reactions, headaches, nausea, or interactions with other medications. Detailed information about specific risks and side effects will be provided with any prescribed medication. You are encouraged to discuss any concerns with our physicians or contact Hati Health support before starting treatment. By proceeding, you acknowledge that you understand these potential risks and agree to follow the physician’s instructions.
3. Consent for Collection, Processing, and Storage of Personal and Medical Data
To provide telemedicine services, Hati Health collects, processes, and stores your personal and medical information, including but not limited to your name, contact details, medical history, and consultation responses. This information is used to:
- Evaluate your health and medical needs;
- Issue prescriptions or referrals;
- Process orders for medications or services; and
- Improve our platform and services.
Hati Health complies with the Philippine Data Privacy Act of 2012 and implements appropriate security measures to protect your information. Your data may be shared with licensed physicians, partner pharmacies, and trusted third-party service providers solely for the purpose of delivering our services. By agreeing to this consent, you authorize Hati Health to collect, process, and store your data as described in our Privacy Policy.
4. Evaluation by a Licensed Physician
All medical evaluations and prescriptions provided through Hati Health are conducted by licensed physicians registered in the Philippines. These physicians will review the information you submit during the telemedicine consultation to determine the appropriateness of any treatment or prescription. You understand that providing accurate and complete information is essential for safe and effective care, and you agree to do so. Prescriptions will only be issued if deemed medically appropriate by the physician.
Acknowledgment and Consent
By proceeding, you confirm that you:
- Have read and understood the information provided in this Telemedicine Informed Consent Form;
- Consent to Hati Health’s telemedicine services, including evaluation by a licensed physician and potential issuance of prescriptions;
- Acknowledge the potential risks and side effects associated with the treatment;
- Authorize the collection, processing, and storage of your personal and medical data as described; and
- Agree to provide accurate information and follow the physician’s instructions.

Annex B
This Annex forms part of the Hati Health Telemedicine Informed Consent Form and applies when you avail of online counseling or coaching services through Hati Health’s partner mental health providers. By proceeding with a booking, you acknowledge and agree to the following terms:
1. Authorization
You authorize licensed mental health practitioners engaged by Hati Health and its partners to conduct counseling or coaching services via video conferencing technology (e.g., Zoom or similar platforms).
2. Equipment Requirement
You understand that you will need access to a device with video and audio capability (e.g., computer, smartphone, tablet) to participate in online sessions.
3. Session Recording
Sessions may, with your consent, be audio- or video-recorded by the counselor/coach or authorized personnel. These recordings may be used only for the following purposes:
- Quality control and training
- Session review to better support your care
- Research and assessment
- Building predictive models to improve services
All recordings shall remain confidential and used only as authorized by the provider. You may withdraw your consent to recording for future sessions at any time by submitting a written request to Hati Health or the provider.
4. Technical Limitations
You acknowledge that technical issues (e.g., internet connectivity problems) may occur before or during your session. If your appointment cannot start or proceed as intended, your counselor will wait up to 15 minutes before closing the session and may reschedule as necessary.
5. Session Environment
You agree to attend sessions in a quiet, private space free of distractions (including silencing phones or devices) to maintain confidentiality and session effectiveness.
6. Attendance and Cancellations
You agree to attend sessions on time. If you need to cancel or reschedule, you must provide at least 48 hours’ notice prior to your appointment, in line with Hati Health’s general cancellation and rescheduling policy. Requests made less than 48 hours before the scheduled appointment will be treated as completed and may be subject to the applicable rescheduling fee.
7. Records and Confidentiality
Your session records may be retained for further evaluation, analysis, and documentation. All information will be kept private and confidential. The same laws and standards that protect confidentiality in in-person counseling also apply to online sessions.
Confidentiality may only be broken under the following exceptional circumstances:
- Disclosure or suspicion of abuse
- Indications of suicidal intent or attempt
- Threats of harm to self or others
- Court orders or legal requirements
8. Limits of Online Counseling
You understand that online counseling is different from in-person therapy. If your counselor believes that another form of intervention would better serve your needs, you may be referred to a different specialist.
9. Voluntary Participation
You confirm that you are voluntarily availing of counseling or coaching services and are not being coerced into participation.
